We are proud to announce that Jerzy Martini has been distinguished in this year’s Ranking of Tax Advisory Firms of Dziennik Gazeta Prawna, taking:

• 1st place in the VAT category,

• 2nd place ex aequo in the Local Taxes and Fees category.

This honor is awarded on the basis of substantive achievements and significant successes in tax litigation. Among them, a special place is occupied by:

• The judgment of the Court of Justice of the EU (C-241/23) – in a case concerning the determination of the VAT tax base on the contribution of real estate in exchange for shares. The Court ruled that, in such a case, the tax base is the issue value of the shares, if it was specified by the parties as payment. The ruling ends years of doubts and disputes with tax authorities, paving the way for many taxpayers to settle transactions more favorably.

• Judgment of the Supreme Administrative Court – a landmark ruling in the field of tax liability of entrepreneurs, according to which a taxpayer cannot be held liable for tax fraud committed by an interim administrator.
