Representation before the CJEU
Representation before the Court of Justice of the European Union is an exceptional proceeding, which happens in very few cases. This is because the decision to refer a case before the CJEU is made by Polish administrative courts, which, at the request of the taxpayer or on their own, may refer a question for a preliminary ruling regarding doubts about the interpretation or validity of acts of EU law.
Of course, in order to send a relevant request to a Polish administrative court, it is necessary to point out the doubts that have arisen, which requires knowledge not only of Polish tax law, but also of EU regulations such as directives or regulations.
Our experience shows that proceedings before the CJEU can bring tangible results, particularly in cases where there is often an unfavorable line of rulings formulated by Polish administrative courts.
